Terms and conditions

This is a license agreement between you and O. Væring that explains how you can use photos and illustrations that you license from O. Væring. By using content from O. Væring, you accept the terms of this agreement.

O. Væring images - terms and conditions for the use and reproduction of photographic material.

Please read the agreement carefully.

The following terms and conditions, the content specific invoice, orderform and the content specific online pages located at www.ovaering.no. Applicabel to the licensed content (agreement) between the client and O. Væring Eftf AS ( supplier).

By obtaining, using or paying for any content from supplier, the client agrees to be bound by and comply with all of the terms of this agreement. If the client does not agree with any of the applicable terms, do not obtain or use any content from the supplier.

The Client shall be deemed to have accepted the Supplier’s Terms and Conditions. Any Reproduction by the Client of the Photographic material shall in any event be deemed to be acceptance of these Terms and Conditions. Any Client who has previously dealt with the Supplier on these Terms and Conditions will be deemed to have accepted them by virtue of the Client’s request referred to above.


For the purpose of these terms and conditions (1) PHOTOGRAPHIC MATERIAL means Transparencies, any digital format images, negatives, prints, or other representations of a Painting, or any other item which may be offered for the purposes of Reproduction, (2) PAINTING shall mean any work of art depicted in any Photograph; and (3) REPRODUCTION includes any form of publication or copying of the whole or part of any Painting whether altered or not, and derived from any Photographic material whether by printing, photography, slide projection (whether or not to an audience), xerography, artist's reference, artist's illustration, layout or presentation, electronic or mechanical reproduction or storage by any other means.(4) SUPPLIER shall mean O. Væring Eftf AS, Oslo (5) CLIENT shall mean the company in receipt of this consignment.

Ownership and Intellectual Property

The Supplier and its Content sources retain all right, title, and interest in and to all of the copyrights, database rights, patent rights, trademarks, trade secrets, and all other propriety right in the Content. No rights in any Content are granted except the limited licenses specified in this Agreement. Any right, title or interest arising in any compilation or derivative work created using any Content shall not entitle the Client to use any Content except as permitted hereunder. The Client does not acquire any copyright ownership or equivalent rights in or to any Content or any other property of the Supplier or its Content sources as a result of any license the Supplier grants to the Client. The Client hereby allows the Supplier to use without charge the Client‘s End of Use in displays and presentations for the Supplier’s marketing purposes, solely to demonstrate how the Client has used the Content


This agreement is binding between the Supplier and The Client



The prices quoted are recommended prices. For some photographic material a higher price may be charged.

The prices quoted cover one reproduction according to the client's description, if no other arrangement has been agreed upon.

As regards digital products, the prices quoted cover one digital version according to the client's description.

If a photographic material is reused in the same edition of a publication or in the same version of a digital product, and if the product's content and appearance is similar to the first edition or version, 50% of the basic price will be charged. In case of another or a new edition/version, an addition of 100% of the basic price will be charged. If the same publication is issued in several languages, 50% of the basic price will be charged for each new edition. In case of an increased number of editions, other or more extensive use than stated in the price list, a new price will have to be agreed upon.The prices quoted apply as per January 1st. 2015. Any fees in relation with the transfer, or exchange of the agreed sum, must be covered by the client.


Publishing rented high resolution files or other material on internet is not permitted. A fee of NOK 20.000 per instanse of use/ reuse will be charged.

For use of any photographic material without permission, i.e. including reuse, a fee of NOK 5000 per instance of use/reuse will be charged.

The receptor's right to using photographic material applies only when the order form has been filled in, signed and returned.

The photographic material must not be rented or sold to a third party, without a separate agreement with O. Væring Eftf. AS.

When using photographic material "© Photo: O Væring Eftf. AS, Norway" shall be referred to as the source if no other arrangement has been agreed upon. In case of lacking or incorrect photo-credit an additional fee of 50% will be charged. (For further information, see Norsk lov om opphavsrett til åndsverk av 12. mai 1962 nr. 2, the Norwegian legislation relating to intellectual property.)

One sample of the product in which the photographic material(s) is (are) included, should be sent us when it is made available for sale.

If a received rented photographic material are unused, a fee will be charged for service.

Photographic material must only be stored electronically if this is part of the agreement with O. Væring Eftf. AS. When publishing manipulated photos, this is to be indicated in the source reference with "MONTAGE" or an "M" symbol; and only when permission to altering the picture is given.

Part of the O. Væring artwork collection is under artist copyright. Renting photographic material does not automatically give the client a right to publishing them. The user of the photo is responsible for obtaining permission from the intellectual property holder or the person managing these rights in the country in question. O. Væring Eftf. AS does not assume any financial responsibility for any errors in captions/labels on photos rented out.
